Participant Terms of Research Procedure 

PMA Everlasting Peptide Longevity (“DripDok,” “we,” “us,” “our”) thank you for visiting our website (the “Site”) or mobile application (the “App”). These Terms of Research Procedure(s) (“Terms”) govern your access to and use of the Site and the App and their related internet-based research procedures, features, content, and functionality, including the Appointment Booking Research Procedure (the “Booking Research Procedure” and, together with the Site and the App, the “Research Procedure” or “Research Procedures”).

By purchasing you agree to all written here.

By using the Research Procedure, you acknowledge that you have read, accepted, and agreed to be bound by these Terms.

1. ACCEPTANCE OF TERMS

These Terms constitute an electronic contract that explains the legally binding terms of your use of the Research Procedure. By using the Research Procedure, you accept and agree to these Terms and any conditions or notices contained or referenced within. You acknowledge that these Terms may be modified by us at any time, in our sole discretion, and that any modifications will be effective upon posting. Your continued use of the Research Procedure shall indicate your acceptance of any modified terms. Further, you agree that we may at any time, in our sole discretion, with or without prior notice to you, modify, cancel, update, reconfigure, supplement, limit, terminate, or otherwise alter the Research Procedure or any part thereof, including as between different users, whether temporarily or permanently.

By using the Research Procedure, you also agree that we may send you various communications by email. After submitting a booking form, you may receive occasional newsletters and offers from us via email. We will not sell or distribute your email address to any third party at any time. You can unsubscribe from these emails at any time. View our Privacy Policy here. You agree to notify us promptly if your email address changes. This consent covers all actions you conduct through the Research Procedure. Should you decide that you do not wish to receive communications by email, please contact us through our contact form. Your withdrawal of consent will be effective within a reasonable time after we receive such notice. A withdrawal of consent will not affect the enforceability of these Terms. However, a withdrawal of consent to receive communications electronically may result in termination of your use of the Research Procedure.

We reserve the right to, and you acknowledge and consent that we may (but are not required to), monitor the Research Procedure to the extent permitted by law, including your communications and activities via the Research Procedure, and in connection with your access and use of the Research Procedure, including without limitation, the information provided by you and information about your geolocation.

2. USER ACCOUNT

In order to access certain features of the Research Procedure, you may be asked to create a User Account. In creating a User Account, you may be asked to provide certain personalized information to us. Our information collection and use policies with respect to the privacy of such information are set forth in the Research Procedure’s Privacy Policy, which is incorporated herein by reference for all purposes. It is your responsibility to provide us with accurate, complete, and up-to-date information for your account. You agree to promptly update such information as needed.

When you create a User Account, you agree to take full responsibility for maintaining the confidentiality of your access credentials used to log into the Research Procedure (e.g., username and password), and for all activity that is generated by your User Account. You may not permit anyone else to use your access credentials, and you may not use anyone else’s access credentials. You may not attempt to gain unauthorized access to any other user’s access credentials. You agree to immediately notify us in the event that (i) your access credentials are lost or stolen, or (ii) you become aware of any unauthorized use of your access credentials or of any other breach of security that might affect the Research Procedure. We are not responsible for any loss or damage arising from someone else using your access credentials or your failure to comply with this section.

3. GENERAL USE OF THE RESEARCH PROCEDURE

Limited License. Subject to your compliance with these Terms, we hereby grant you a limited, revocable, non-exclusive, non-sublicensable, non-transferable license to: (i) access and use the Research Procedure on a device that you own or control solely in connection with your use of the Research Procedure; and (ii) access and use any content information and related materials that may be made available through the Research Procedure to you, in each case solely for your personal use. Any rights not expressly granted herein are reserved by DripDok and its licensors.

Prohibited Uses.

Any commercial or promotional use, distribution, reproduction, or other exploitation of the Research Procedure, or any content, code, data, or materials on either the Site or the App, is strictly prohibited unless you have received express prior written permission from us. Other than as expressly allowed in these Terms, you may not download, post, display, publish, copy, reproduce, distribute, transmit, modify, perform, broadcast, transfer, create derivative works from, sell or otherwise exploit any content, code, data, or materials on or available through the Research Procedure. You further agree that you may not alter, edit, delete, remove, or otherwise change the meaning or appearance of, or repurpose, any of the content, code, data, or other materials on or available through the Research Procedure, including, without limitation, the alteration or removal of any trademarks, trade names, logos, Research Procedure marks, or any other proprietary content or proprietary notices. If you make other use of the Research Procedure, or its content, code, data or materials, except as otherwise provided above, you may violate copyright and other laws of the United States, other countries, or applicable state laws and may be subject to liability for such unauthorized use.

You shall not: (i) engage in spidering, “screen scraping,” “database scraping,” harvesting of email or other addresses, contact or personal information, or any other automatic means of obtaining lists of users or other information from or through the Research Procedure, including without limitation any information residing on any server or database connected to the Research Procedure; (ii) obtain or attempt to obtain unauthorized access to computer systems, materials, or information through any means; (iii) use the Research Procedure in any manner with the intent to interrupt, damage, disable, overburden, or impair the Research Procedure, including, without limitation, sending mass unsolicited messages or “flooding” servers with requests; (iv) use the Research Procedure in violation of our or any third party’s intellectual property or other proprietary or legal rights; (v) insert your own or a third party’s advertising, branding or other promotional content into any of the Research Procedure’s content, materials or Research Procedures; or (vi) use the Research Procedure in violation of any applicable law. You further agree that you shall not attempt (or encourage or support anyone else’s attempt) to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the Research Procedure, or any content thereof, or make any unauthorized use thereof. You agree that you shall not sue the Research Procedure in any manner that could damage, disable, overburden, or impair the Research Procedure or interfere with any other party’s use and enjoyment of the Research Procedure.

Proprietary Rights.

The Research Procedure is the proprietary property of DripDok and/or its third-party licensors, and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. All trade names, trademarks, service marks, and other Research Procedure marks on the Research Procedure are the proprietary property of DripDok and/or its third-party licensors. You may not use, display, reproduce, or otherwise exploit any of the Research Procedure marks without our prior written permission.

4. PRIVACY POLICY

Your use of the Research Procedure is governed by our Privacy Policy, which can be found at [Insert Link to Privacy Policy]. By using the Research Procedure, you consent to the collection and use of your personal information as set forth in the Privacy Policy.

5. DISCLAIMERS

THE RESEARCH PROCEDURE IS PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT ANY WARRANTIES OR CONDITIONS (EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE) ARISING UNDER STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF PERFORMANCE OR DEALING. YOUR USE OF THE RESEARCH PROCEDURE IS AT YOUR SOLE RISK. TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE, ON BEHALF OF OURSELVES AND OUR THIRD-PARTY SERVICE PROVIDERS, EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

WE MAKE NO WARRANTY (I) THAT THE RESEARCH PROCEDURE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (II) THAT YOUR ACCESS TO OR USE OF THE RESEARCH PROCEDURE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, (III) THAT ANY DEFECTS IN THE RESEARCH PROCEDURE WILL BE CORRECTED, OR (IV) THAT THE RESEARCH PROCEDURE OR ANY SERVER THROUGH WHICH YOU ACCESS THE RESEARCH PROCEDURE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, QUALITY, SUITABILITY, TRUTH, COMPLETENESS, OR TIMELINESS OF THE RESEARCH PROCEDURE OR THE CONTENT CONTAINED THEREIN, INCLUDING WITHOUT LIMITATION ANY CONTENT SUBMITTED BY USERS OF THE RESEARCH PROCEDURE. 6. LIMITATIONS OF LIABILITY

IN NO EVENT SHALL WE (OR OUR AFFILIATES, SUPPLIERS, LICENSORS, OR SERVICE PROVIDERS) BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO OR USE OF THE RESEARCH PROCEDURE, INCLUDING BUT NOT LIMITED TO ANY DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING UNDER STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF PERFORMANCE OR DEALING, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, DAMAGES ARISING FROM OR IN CONNECTION WITH MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF DripDok, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE, OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY, OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE RESEARCH PROCEDURE EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO US FOR ACCESS TO OR USE OF THE RESEARCH PROCEDURE. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN THE LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

7. RELEASE AND INDEMNIFICATION

You agree to release, defend, indemnify, and hold harmless DripDok, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Research Procedure, your violation of these Terms, your violation of any third party right, your violation of any applicable law, and your participation in any Booking Research Procedure. We shall provide notice to you of any such claim, suit, or proceeding. We reserve the right, at your expense, to assume the exclusive defense and control of any matter which you are required to indemnify against. You agree that the provisions in this paragraph will survive any termination of your access to or use of the Research Procedure.

8. THIRD PARTY LINKS, SERVICES, AND CONTENT

The Research Procedure may contain links to third-party websites, applications, or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. If you access a third-party website from the Research Procedure, you do so at your own risk, and you understand that these Terms and our Privacy Policy do not apply to your use of such sites. You expressly relieve us from any and all liability arising from your use of any third-party website or services or third-party owned content. Additionally, your dealings with or participation in promotions of advertisers found on the Research Procedure, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. You agree that we shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers.

9. TERMINATION

We reserve the right, without notice, at our sole discretion and without liability to you, to terminate or suspend your User Account or your access to or use of the Research Procedure or any of their features or functionality for any reason, including without limitation if we believe that you are under 18 years of age or you provide false or misleading information, do not comply with these Terms, or engage in any improper conduct.

10. LIMITATION OF LIABILITY

Exclusion of Certain Liability: You acknowledge and agree that we provide access to the RESEARCH PROCEDURE with limitations on our liability to you and third parties. To the extent allowed by applicable law, DripDok, its directors, advisors, officers, employees, agents, or content providers (“Protected Entities”) shall not be liable for indirect, consequential, special, incidental, punitive, or exemplary damages, or loss of use, data, business, revenues, or profits, whether direct or indirect, arising from the RESEARCH PROCEDURE or these Terms, regardless of the legal theory, even if we were advised of the possibility of such damages.

Limitation of Liability: To the extent permitted by applicable law, the aggregate liability of the Protected Entities for the RESEARCH PROCEDURE and these Terms will not exceed the amount paid by you, if any, for accessing the RESEARCH PROCEDURE, even if your remedies under these Terms fail.

11. TERM AND TERMINATION

These Terms are in effect until terminated as outlined herein. Either party may terminate these Terms at any time without notice. Upon termination, DripDok will cease providing the RESEARCH PROCEDURE.

12. INFORMATION

We do not warrant the accuracy, completeness, or timeliness of information on the RESEARCH PROCEDURE. You may not use this information for commercial purposes.

13. AVAILABILITY

We aim for outstanding uptime and reliability, but planned downtime and factors beyond our control may lead to unavailability. We do not guarantee continuous access.

14. INFORMATION SECURITY

We implement security measures to protect your information, but we cannot guarantee its security from third-party access.

15. INTERNATIONAL VISITORS

We operate the RESEARCH PROCEDURE from Indonesia, and it may not be suitable for use in other locations. Users accessing it from elsewhere are responsible for compliance with local laws.

16. INTELLECTUAL PROPERTY AND COPYRIGHT INFRINGEMENT

We respect intellectual property rights. If you believe there’s infringement, contact us. We’ve designated a Copyright Agent under the Digital Millennium Copyright Act.

17. ELECTRONIC COMMUNICATIONS

You consent to electronic communications, acknowledging the inherent risks of the Internet and that information transmitted online is not confidential.

18. REMEDIES FOR BREACH

We reserve the right to take action if you breach these Terms, including removal from our services.

Terms and Conditions for Research At-Home Services

Welcome to our At-Home IV Services. By choosing our services, you agree to the following terms and conditions. Please read them carefully.

  1. Service Agreement: Our At-Home IV Services are designed to provide you with convenient and professional medical care in the comfort of your own home. These services are to be conducted by qualified healthcare professionals.

  2. No Refund Policy: All sales of our IV services and related products are final. Due to the nature of these services and the customization for individual needs, we cannot offer refunds once a service appointment has been confirmed and paid for.

  3. Rescheduling and Cancellation Policy: We understand that schedules can change and offer the flexibility to reschedule appointments. However, please note the following:

    • Last-Minute Rescheduling: A surcharge will apply to appointments rescheduled within 24 hours of the planned service time. This fee compensates for the rearrangement of resources and scheduling, this fee is the cost of travel and handling which is between $5-$25.

    • Cancellation Fee: Appointments canceled within 24 hours of the scheduled time will incur a cancellation fee of $15.

  4. After-Hours Service Fee: We offer extended service hours for your convenience. For appointments scheduled during late-night hours (as defined by our service hours policy) or after standard operating hours, an additional fee of $75 will be charged. This fee covers the additional costs associated with after-hour services.

  5. Service Area Limitations: Our services are available within a specific geographical area. Services requested outside of this area may incur additional travel fees or may not be available.

  6. Client Responsibility: It is your responsibility to provide a safe and suitable environment for the IV service. You must disclose all relevant health information, including allergies, medical history, and current medications, to ensure safe and effective treatment.

  7. Professional Discretion: Our healthcare professionals reserve the right to refuse or discontinue service if a situation is deemed unsafe or if the client’s medical condition is not suitable for the treatment provided.

  8. Privacy and Confidentiality: We are committed to protecting your privacy. All personal and medical information will be handled in accordance with applicable privacy laws.

  9. Liability: While we strive to provide the highest standard of care, we are not liable for unforeseen complications or side effects that may arise as a result of the treatment, provided all protocols and professional standards have been followed.

By availing of our At-Home Services, you acknowledge that you have read, understood, and agreed to these terms and conditions. For further details or inquiries, please contact our customer service team.

Travel Disclosure and Prescription Policy

1. Disclosure of Intent to Travel:

Clients must disclose any intention to travel with peptides during the initial consultation call and prior to completing any purchase. This disclosure must include the specific country or countries to which the client intends to travel. Failure to disclose this information will result in the clinic being under no obligation to provide any post-purchase prescriptions, travel documentation, or support related to the use of peptides during travel.

2. Country-Specific Restrictions:

Dripdok provides travel support for peptides only to countries where we are legally permitted to do so. Clients must verify in advance whether their intended travel destination is supported by Dripdok. The clinic will not issue travel documentation, prescriptions, or any related support for countries where peptide travel is not supported. This includes, but is not limited to, the following countries: Australia, Canada, Japan, Singapore, Russia, China, Saudi Arabia, United Arab Emirates, and Brazil.

3. Responsibility for Legal Compliance:

It is the sole responsibility of the client to ensure that they comply with the local laws and regulations of the country or countries to which they are traveling. Dripdok will not be held liable for any legal issues arising from the client’s failure to comply with these requirements.

4. Prohibition of Last-Minute Prescription Requests:

Dripdok will not accommodate any last-minute requests for prescriptions or travel documentation, regardless of the amount spent by the client. All requests must be made in accordance with the clinic’s established procedures and timelines.

5. Ethical Conduct and Legal Compliance:

Clients are expected to interact with Dripdok staff in an ethical and respectful manner. Any attempts to coerce or pressure staff into providing documentation or services that are illegal or in violation of the clinic’s policies will not be tolerated. Dripdok reserves the right to refuse service to any client who engages in such behavior and to pursue legal action if necessary.

6. Legal Action for Non-Compliance:

Dripdok reserves the right to take legal action against any client who violates these terms and conditions, including but not limited to attempting to obtain illegal prescriptions or documentation, or pressuring staff to engage in unethical practices. Such actions will be pursued in accordance with applicable laws, including but not limited to those governed by Indonesian law.

Terms and Conditions for Promotions

  1. Non-Transferability: Promotions are exclusive to the recipient and cannot be transferred, shared, or used by anyone other than the original recipient.

  2. Validity Period: Each promotion has a specified validity period. Offers must be redeemed within this timeframe.

  3. One Promotion Per Customer: Only one promotional offer can be used per customer or transaction, unless otherwise specified.

  4. Not Combinable: Promotions cannot be combined with any other offers or discounts.

  5. No Cash Value: Promotional offers have no cash value and cannot be exchanged for cash or credit.

  6. Subject to Availability: Offers are subject to availability and may be withdrawn or modified without prior notice.

  7. Eligibility Criteria: Customers must meet all specified eligibility criteria to take advantage of the promotion.

  8. Use Restrictions: The company reserves the right to limit the use of promotions for specific products or services.

  9. Amendments: The company may amend these terms and conditions at any time without prior notice.
